THE DERIVATION OF HUKM (RULINGS) FROM THE PERSPECTIVE OF DR. AL-BOUTI: A CASE STUDY

Abstract
This study aims at providing a brief background of the late Shaykh Dr. al-Butiyy, and evading some people’s confusion about him on the inference and deduction in the fiqh rulings, which illustrates the comprehensiveness of deduction in light of fiqh, creed, manners, and conduct rulings. The study also attempts to comprehend the methods followed by al-Butiyy in infering Sharia verdicts. The researcher employs the applied analytical method whereby the researcher is able to highlight a number of results related to deduction of rulings such as lifting discomfiture incurred upon the researcher if he is granted all the means to elicit verdicts, as well as the provision of easiness and facility for the reader and researcher through understanding the issues inferred by al-Butiyy who was in the habit of supporting the evidence or incident, and then dealing with what can be deducted thereof.

يهدف البحث إلى التعرف على نبذة مختصرة عن الشهيد البوطي، ثم دفع ما قد يتوهمه البعض أن الاستنباط إنما يكون في الأحكام الفقهية، وذلك لبيان شمولية الاستنباط في الأحكام الفقهية، والعقيدة، والآداب، والسلوك، ثم يهدف أيضا إلى فهم كيفية الطريقة التي سار عليها البوطي في استنباطه للأحكام، وذلك من خلال استقراء الأحكام والمواقف والسلوكيات التي كان يستنبط من خلالها الأحكام الشريع.، وقد سلك الباحث المنهج التحليلي التطبيقي، وقد توصل الباحث إلى جملة من النتائج التي تتعلق باستنباط الأحكام، كعدم وجود الحرج على الباحث إن أراد أن يستنبط الحكم الشرعي إن توفرت لديه وسائل الاجتهاد، وتوفير السهولة واليسر للباحث والقارئ وذلك من خلال الاطلاع على المسائل المستنبطة عند البوطي، فقد كان يبدأ بذكر الدليل أو الواقعة ثم يتطرق إلى الاستنباط من ذلك الدليل أو الواقعة.
