Hadith of the Prophet Muhammad appeared more than 1400 years ago and derived from divine revelation (wahyu). Its authenticity is closely guarded by scholars using various methods including by organising of hadith dirayah knowledge to screen whether it is an authentic, daif or false hadith. Hadith is very authoritative argument in Islamic in addition to the Quran. It is the most important resource in the fatwa issuance process. However, its use is disputed by scholars where there are scholars who do not allow the use of the current daif hadith and there is also the opposite opinion. It also gets the same disputes among the legislators of the Syariah rulings (law) in Malaysia i.e tha mufti. Hence, this study aims to determine the extent of permissible use of daif Hadith in the production of Islamic law and its practices among muftis in Malaysia. This research was conducted qualitatively by refering to the debate on the books of hadith, interviews and related papers. The results showed that the opinion does not justify the practice of daif hadith in the fatwa was rajih. The study also found that there were some mufti departments who use daif hadith in the production of the Syariah law process. Thus, the study suggested that the mufti uses sahih hadith while determining Syariah hukm in order to avoid negative implications of such weak fatwa finding which could lead to unsynchronized fatwa between mufti departments.

Hadis Nabi SAW muncul lebih daripada 1400 tahun yang lalu dan ia adalah bersumber daripada wahyu. Kesahihannya dijaga dengan teliti oleh para ulama dengan menggunakan pelbagai metode antaranya dengan menyusun ilmu dirayah hadis bagi menyaring sesuatu hadis sama ada ia sahih, daif ataupun palsu. Hadis adalah dalil yang amat berautoriti dalam Syarak selain al-Quran. Ia adalah sumber terpenting dalam proses pengeluaran fatwa. Walau bagaimanapun, penggunaannya diperselisihkan oleh para ulama iaitu terdapat para ulama yang tidak membenarkan penggunaan hadis daif semasa berhukum dan terdapat juga pendapat di sebaliknya. Hal ini juga mendapat perselisihan yang sama di kalangan penggubal hukum di Malaysia iaitu mufti. Justeru, kajian ini adalah untuk mengetahui sejauh mana dibolehkan penggunaan hadis daif dalam pengeluaran hukum Syarak serta pengamalannya di kalangan mufti di Malaysia. Penyelidikan ini dilakukan secara kualitatif dengan merujuk kepada perbahasan kitab-kitab hadith, temubual dan pekeliling yang berkaitan. Hasil kajian menunjukkan bahawa pendapat yang tidak membenarkan pengamalan hadis daif dalam fatwa adalah rajih. Kajian juga mendapati terdapat beberapa Jabatan Mufti mengamalkan hadis daif dalam proses pengeluaran hukum. Justeru, kajian mencadangkan agar para mufti menggunakan hadis sahih ketika berhukum agar dapat mengelakkan implikasi yang negatif seperti dapatan fatwa yang lemah dan boleh membawa ketidak seragaman fatwa antara Jabatan-Jabatan Mufti.
